Descriptions and definitions.


Assault and Battery
      Often used interchangeably, Assault and Battery are two separate and distinct crimes.  In Florida, a misdemeanor Assault is defined as an intentional and unlawful threat, either by word or act, to do violence to another, and at the time, appearing to have the ability to carry out the threat, and the act must create in the mind of the victim a well-founded fear that the violence is about to take place.  Therefore, actual physical contact is not an element of Assault in Florida.  The crime of Battery in Florida is defined as either intentionally touching or striking someone against that person’s will or intentionally causing bodily harm to someone.  Battery, in its most basic form, is also a misdemeanor.  However, both Assault and Battery can be felony crimes if any one of a number of aggravating circumstances are present (i.e., an Assault committed with a deadly weapon or with an intent to commit another crime, a Battery causing great bodily harm or permanent disability, a Battery committed with a deadly weapon or upon a pregnant victim, among others).

Burglary
     Burglary in Florida is defined as the unlawful entering or remaining in a dwelling, structure, or conveyance with, at the time of entry, the intent to commit a separate offense therein.  All Burglary charges in Florida are felonies ranging in severity from 3rd degree to 1st degree, punishable by life, with the severity dependent upon factual differences such as whether the Burglary was of a dwelling, accompanied by a Battery, committed while armed, among others.

Contracts
     In law, a contract is a binding legal agreement that is enforceable in a court of law.  That is to say, a contract is an exchange of promises for the breach of which the law will provide a remedy.  Binding contracts can be in writing or simply verbal agreements.  Often it is necessary to go to court to enforce the terms of a contract.

Drug Offenses
     Florida prisons are packed with drug offenders of one form or another.  Whether you like it or not, the drug laws are what they are, they are strict, and they do not appear to be going away any time in the near future.  Drug offenses range from misdemeanor possession of small amounts of marijuana to first degree felony trafficking charges with lengthy mandatory minimum prison sentences.  There are many technical and complicated legal issues involved with defending drug offenses including, but certainly not limited to, the legality of the stop, the legality of the search, whether the state can prove knowledge of the elicit nature of the substance, whether the state can prove what the substance actually is, whether the state can prove the amount it has charged, wiretap issues, the use of confidential informants who often times do not wish to testify, among others.  Our attorneys have conducted many drug related criminal jury trials.  Let our experience work for you.

DUI / Criminal Traffic Offenses
     The crime of DUI can and does affect a wide range of the population.  You, your neighbor, your relative, your friend, your boss, anyone is at risk of being stopped for suspicion of DUI, whether they have been drinking or not, or, if they have been drinking, whether their normal faculties are actually impaired or not.  Local law enforcement loves to brag about being “aggressive” with their DUI enforcement.  While this certainly helps Sheriffs in their re-election bids, it also results in good people frequently being stopped, arrested, jailed, and charged with DUI after only having a drink or two.  Even those who blow under the legal limit can and usually will still be arrested for DUI.  A DUI arrest and/or conviction can have many negative consequences including, but not limited to, administrative suspension of driver license, judicial suspension of driver license, permanent criminal record, probation, classes, fines, community service hours, and more.  The crime of DUI can range from a misdemeanor offense to a first degree felony depending on the circumstances.  In addition to DUI, other criminal traffic offenses such as reckless driving, racing, driving while license suspended, and others may result in similar issues and need experienced representation to be defended properly.  Our attorneys have handled DUIs and other criminal traffic cases from the very start of their legal carriers as prosecutors.  Let our experience work for you.

Foreclosure
     Facing foreclosure?  Our firm represents those facing foreclosure of their home, investment properties, or businesses.  We do not and will not make outrages and unrealistic promises regarding foreclosure and your ability to modify your loan, etc.  The fact of the matter is, and our experience has confirmed this, the banks currently, for whatever reason, simply are not willing, in nearly every case but not all, to lower the principal amount of the loan.  Our experience in this area has shown us that we can best serve our clients facing foreclosure by responding, on behalf of our clients, to the foreclosure complaint in court by initially filing an answer or a motion to dismiss, depending on the facts.  Lenders often do not have possession of the note and mortgage they have filed to foreclose upon and they may not have the proper authority to do so.  Having an attorney on your side defending your interests in court, even if ultimately not successful in the end, typically dramatically slows down the process and provides our clients with the opportunity and extra time to set their money aside and/or mediate with the bank to discuss any possible loan modifications and/or make plans for future living arrangements.

Injunction
      An injunction is an equitable remedy in the form of a court order, whereby a party is required to do, or to refrain from doing, certain acts.  The party that fails to adhere to the injunction faces civil or criminal penalties and may have to pay damages or accept sanctions for failing to follow the court's order.  In some cases, breaches of injunctions are considered serious criminal offences that merit arrest and possible jail sentences.

Landlord-Tenant / Eviction

Paternity
     Where paternity of the child is in question, a party may ask the court to determine paternity of one or several possible fathers (called putative fathers) based initially upon sworn statements and then upon testimony or other evidence.    A successful application to the court results in an order assigning paternity to a specific man, possibly including support responsibility and/or visitation rights.

Robbery
     In Florida, the crime of robbery is defined as the taking of money or other property from the person or custody of another by force, violence, or assault, or by putting in fear.  Additionally, the property taken must be of some value, and the taking done with the intent to permanently or temporarily deprive the victim of his or her rights to the property or any benefit from it.  Robbery charges are considered serious violent felonies and range from second degree felonies to first degree felonies, punishable by life (Robbery with a firearm or other deadly weapon and Carjacking with a firearm or other deadly weapon).

Theft
     In Florida, theft is defined as the act of knowingly obtaining, using, or endeavoring to obtain or to use the property of another with the intent to either temporarily or permanently deprive.  Depending on the amount taken and the nature of the victim, thefts in Florida range from the lowest level misdemeanors to first degrees felonies.
